इलाहाबाद हाईकोर्ट ने गलत वेतन भुगतान के आधार पर काटी गई ग्रेच्युटी राशि को छह प्रतिशत ब्याज के साथ वापस करने का आदेश दिया है।
कोर्ट ने जिला पंचायत राज अधिकारी एवं वरिष्ठ कोषाधिकारी संत कबीर नगर को एक महीने के भीतर रुपये वापस करने का निर्देश दिया है। यह आदेश न्यायमूर्ति सलिल कुमार राय की कोर्ट ने भागीरथी की याचिका की सुनवाई करते हुए दिया।
मामले में याची भागीरथी यूपी के पंचायती राज विभाग, लखनऊ में ग्राम पंचायत अधिकारी के पद पर तैनात थे और 31 जुलाई 2020 को सेवानिवृत्त हुए। सेवा के दौरान गलत वेतन निर्धारण के कारण उन्हें अतिरिक्त राशि का भुगतान कर दिया गया। इस आधार पर जिला पंचायत राज अधिकारी, संत कबीर नगर के आदेश से सेवानिवृत्ति के दौरान याची की ग्रेच्युटी से 5,90,061 रुपये की कटौती की गई। इसके विरोध में याचिका दायर की गई।
कोर्ट ने पंजाब राज्य और अन्य बनाम मामले में सुप्रीम कोर्ट के फैसले के आधार पर अतिरिक्त भुगतान की वसूली के आदेश को रद्द कर दिया। साथ ही कहा कि एक माह के भीतर छह प्रतिशत ब्याज प्रतिवर्ष की दर से रुपये वापस किए जाएं।

Heard the counsel for the petitioner.
The petition is being decided on the basis of facts stated in the impugned orders and, therefore, no counter affidavit is required.
The petitioner was posted as Gram Panchayat Adhikari in the Department of Panchayati Raj, U.P. at Lucknow and retired from service on 31.7.2020.
An amount of Rs. 5,90,061/- has been deducted from his gratuity on the ground that the petitioner was paid excess amount in salary because of wrong fixation of his salary while the petitioner was in service. Orders to that effect have been passed by the District Panchayat Raj Officer, Sant Kabir Nagar on 6.4.2021 and 22.3.2021.
The orders directing recovery of the petitioner are contrary to law in light of the judgement of the Supreme Court in State of Punjab and Others Vs. Rafiq Masih (White Washer) and Others, reported in (2015) 4 SCC 334. The orders dated 6.4.2021 and 22.3.2021 passed by the District Panchayat Raj Officer, Sant Kabir Nagar directing recovery of alleged excess payment to the petitioner are hereby quashed.
The District Panchayat Raj Officer, Sant Kabir Nagar and the Senior Treasury Officer, Sant Kabir Nagar are directed to refund Rs. 5,90,061/- alongwith 6% simple interest per annum to the petitioner within one month from today and in any case by 31.5.2024.
With the aforesaid directions, the petition is allowed.
